BeeBop provides services under the following terms and conditions. When you order or purchase one of our Services you must agree to these terms. The agreement is effective once the customer clicks to accept the terms and conditions.
"Services" are those BeeBop services delivered through its website.
Under the provision of our cloud services, BeeBop provides you resources so that you can create instances.
Instances have a dedicated storage space and part of the RAM and CPU resources of our host servers. Depending on the plan or configuration and instance type you contracted, it is the amount of resources of RAM and CPU that are assigned, or is guaranteed to you (instances RAM and instances CPU) or is shared with other users who have instances installed on the same servers. In the case of shared resources, we can not guarantee performance.
BeeBop provides a control panel that lets you manage the Service, configure instances (creation, deletion, etc.) or view reports.
You may only access BeeBop Infrastructure, in which instances are installed, via the Internet. Therefore, the Customer must have an Internet connection to connect to the control panel and access the Service, and is solely responsible for the connection, especially in terms of availability, reliability and security.
In case of malfunction of the Service, and if Beebop is responsible, you can contact the BeeBop support service from the control panel or through other channels indicated in beebop.cloud.
You must purchase the service through the BeeBop website.
Once BeeBop have activated the Service, you will be able to create instances in the control panel.
BeeBop provides different instances configurations, described on the BeeBop website.
Before choosing an instance, you must commit to study carefully each instance configuration available. It is your responsibility to define the configuration and the operating system that best meets your needs and expectations.
Hardware resources (server, storage, etc.) and the Instance rented by you, are the exclusive property of BeeBop.
As part of this agreement, you are the sole administrator of the instance, unless your plan considers BeeBop team administers it. If the client does not have a plan that includes managing instances, BeeBop not intervene in any way in the management of the client instance.
BeeBop itself is responsible for the administration of the infrastructure (hardware, network, host servers, disks) in which are configured your instances.
You confirm to own the range of expertise required to ensure proper management of resources (instances) made available by BeeBop and perform backups of the data stored on these resources. You also agrees to study and analyze the information made available by BeeBop.
You has the possibility to install software in the instances you create. These installations are done under your full responsibility and BeeBop cannot be held responsible for a malfunction of the instance as a result of these installations.
You agree to respect the conditions of license and use 1) of the operating system with which the instance has been configured by BeeBop, and 2) the applications preinstalled by BeeBop in the instance. BeeBop reserves the right to update these operating systems and applications preinstalled on the instance.
BeeBop reserves the right to filter certain ports considered sensitive for the preservation of the Infrastructure. In addition, limitations on UDP/ICMP flows are applied.
Under the service, you has the right, through the control panel to increase or decrease the number of instances, as well as to modify the Instance (s) to enjoy a new configuration. These changes are executed asynchronously from the request. You can makes the request in the control panel or through the BeeBop API.
BeeBop reserves the right to limit or restrict certain functions of the body in order to ensure the security of its infrastructure. BeeBop will inform the customer as far as possible on the implementation of these locks.
You agree to provide accurate information when registering for BeeBop Services.
BeeBop provides you access to a service that allows you to store your data and those of your customers. You assume fully the risks and dangers of their activity. You are solely responsible for the services and Web sites hosted on your instances, the content of the information transmitted, broadcasted or collected, and for its exploitation and update.
You are responsible for taking all technical measures to the conservation and possession of the connection logs or other data whose nature allows to identify who have contributed to the creation of the content or any of the content of the services which you are the supplier, according to the law.
You fully assume the consequences of malfunction of its instances resulting from misuse by staff members or any person to whom you has provided his or her password or other means of access. You also fully assume the consequences of the loss of such passwords and other means of access.
In order to maintain the level of safety of your instance and all the servers present in your infrastructure, BeeBop reserves the right to require updates to the operating system of your instance and the applications preinstalled by BeeBop in which we have detected a security breach. If you do not upgrade the operating system and such applications after the BeeBop notice, we reserve the right to interrupt the Internet connection of your instance and Infrastructure.
Similarly, if BeeBop detected a security problem in your instance, we will send you an email, indicating the need for a reinstallation or removal to maintain the integrity of the Instance and the infrastructure. BeeBop reserves the right to interrupt the Internet connection of your Instance until you reinstall your Instance. You must perform operations like transfer data of the system whose security has been compromised to the new system. BeeBop promises and limits its intervention only to the provision of resources for you to build a new system.
You acknowledges that, for safety reasons, certain functions and protocols (such as IRC or file sharing peer-to-peer) may be subject to limitations from the Service. It is prohibited to do (from our Service) services of anonymous connection through proxy and card sharing (CCcam or equivalent).
You are responsible for taking the necessary steps to keep backups of data stored in your instances. BeeBop could not be held responsible for backing customer data.
You must acquire any license or right to use hired to BeeBop. Failing that, BeeBop reserves the right to suspend the Service without notice.
BeeBop can only warn you about the legal consequences that could arise from illicit activities made from the Instance, and disclaims all liability, including solidary, on the use of the data made available to Internet by you.
If you violate the terms of acceptable use BeeBop reserves the right to suspend the Service without notice and terminate the contract immediately and in full.
You may make "snapshots" of instances through the BeeBop control panel. You can also request to restore your instance on the basis of these "snapshots" in which case the instance data will be deleted and the data of the selected Snapshot restored.
Snapshot are a "snapshot" copy of the instance, but in no case constitute a permanent backup of instance data.
These backups may occupy space that will be deducted from the total of GB available according to the assigned plan.
BeeBop monthly guarantee an availability of 99.8% for instances and internal network.
The "monthly availability index" is calculated as follows:
(Total monthly minutes - monthly Minutes without availability / Total monthly minutes) * 100
Unavailability is defined as the loss of connectivity to the active Instance Client for more than three consecutive minutes since the opening of the ticket of incidence, without the possibility for the Customer to restart that instance.
The service level commitment is adopted on the condition that the customer collaborate with BeeBop in restoring service in case of unavailability.
When declaring the incidence and creating the ticket, you must notify BeeBop all useful information for diagnosis and intervention. You must commit to cooperate with BeeBop when requested, to provide information and facilitate the checks and tests. If necessary, you will provide access to your control panel.
If BeeBop finds that the Instance is available and good working order, BeeBop is released from its obligations under this SLA. However, in that case, BeeBop agree, at your request, to assist you so you can identify the origin of the difficulties experienced.
The agreement does not include any commitment regarding the availability of the items that remain under your control, such as software and applications installed on the instance.
The agreement does not apply where the Customer makes instance configurations that prevent BeeBop perform the necessary operations to monitor them.
This agreement shall take effect as of the effective subscription to BeeBop Services and will remain in effect until it is terminated by you or BeeBop.
BeeBop may terminate this contract automatically and without compensation in case of force majeure.
When you do a commitment for either 12, 24 or 36 months, this will be billed in monthly fees and must paid it in full until the end of the period.
If you do not renew and pay your plan 5 days after the end of the previous plan, we will consider you have terminated the agreement.
You may request termination of the contract by sending an email to our support e-mail, or letter to Bustamante 24, Oficina N, Providencia, Santiago, Chile. After reception of the letter, BeeBop has 15 working days to terminate the Services. However, you must pay in full the plan already hired.
If you violate your obligations or acceptable use policies, BeeBop will be entitled to disconnect and/or immediately and without notice suspend your Services and to terminate the contract immediately and as of right, without prejudice to the right to claim for damages that BeeBop can exercise.
Once terminated the contract instances will be deleted, and all associated items and data stored in them.
Restrictions, limitation and suspension mesures or termination of contract shall be performed depending on the severity and recurrence of the breach, and will be determined depending on the nature of the breach found.
You agree in advance that BeeBop make a restriction, limitation or suspension of the Service offered if BeeBop is notified by a competent authority, either administrative, arbitration or judicial, according to the applicable law.
BeeBop also may restrict, limit or discontinue the service if it considers that the provision of services could create a substantial economic burden or technique, or a security risk for us.
